These Terms & Conditions govern your use of the Brent England Photography website and services. By booking a session, visiting this website, or communicating with us, you agree to the policies outlined below.

1. General Information

Brent England Photography (“we,” “us,” “our”) provides portrait, personal branding, couples, and family photography services. We reserve the right to update or modify these Terms & Conditions at any time.

2. Booking & Payment

Session Booking

  • Sessions are reserved on a first-come, first-served basis.

  • A signed agreement and retainer (non-refundable unless stated otherwise) are required to secure your session date.

  • Remaining balances are due on or before the session date unless otherwise arranged.

Retainers

Retainers ensure your date and time are reserved exclusively for you. Retainers are non-refundable because we turn away other bookings for that slot.

3. Cancellations & Rescheduling

Client Cancellations

  • Retainers are non-refundable.

  • Clients may reschedule one time without penalty if proper notice is given (typically 48–72 hours depending on policy).

  • Additional reschedules may require a new retainer.

Photographer Cancellations

If Brent England Photography must cancel due to emergency, illness, or circumstances beyond our control, clients may choose:

  • A full refund of the retainer, or

  • A rescheduled session at no extra cost

4. Weather & Outdoor Sessions

For outdoor sessions, weather can be unpredictable.
We may reschedule due to:

  • Heavy rain

  • High winds

  • Unsafe conditions

  • Poor lighting conditions

Overcast weather is not considered poor weather — it’s usually perfect for photos.

5. Late Arrivals

Sessions start and end at the scheduled time.
Late arrivals may result in:

  • Shortened shooting time

  • Fewer final images

  • Additional fees if extended time is requested and available

Fees will not be reduced for lost time due to lateness.

6. Creative Control

By hiring Brent England Photography, you trust our artistic style and judgment.

This includes:

  • Posing and composition

  • Lighting choices

  • Editing style and color grading

  • Selection of final images

Client requests are welcome, but the final creative decisions will be made by the photographer.

7. Image Editing & Delivery

Editing

All delivered images are professionally edited to Brent England Photography’s style.
This includes color correction, cropping, exposure adjustments, and light retouching.

Turnaround Time

Typical delivery time is 1–3 weeks, depending on the session type and season.

RAW Files

RAW/unedited files are not provided under any circumstances.

8. Image Usage Rights

Client Usage

Clients receive a personal use license for the delivered images.
You may:

  • Post on social media

  • Print for personal use

  • Share with friends & family

You may not:

  • Sell images

  • Alter the images with filters or edits

  • Use images for commercial purposes without written permission

Photographer Usage

Brent England Photography may use images in:

  • Portfolio

  • Website

  • Social media

  • Advertising or marketing materials

Clients may opt out of photo usage by submitting a written request before or at the session.

9. Copyright

All images remain the copyright of Brent England Photography.
Unauthorized reproduction or distribution is prohibited.

10. Model Release

By booking a session, clients grant permission for the photographer to photograph them and any minors included in the session.
Written consent is required for those under 18.

11. Safety & Conduct

We will not photograph:

  • Dangerous situations

  • Illegal activities

  • Locations where photography is prohibited

Disrespectful, threatening, or unsafe behavior may result in immediate termination of the session with no refund.

12. Liability

Brent England Photography is not liable for:

  • Injury during sessions

  • Damaged clothing

  • Allergic reactions to environmental elements

  • Acts of nature or circumstances beyond our control

Our maximum liability for any claim is limited to the amount paid for the session.

13. Gift Cards & Promotions

Promotional rates, discounts, and gift cards:

  • Cannot be combined

  • Cannot be transferred

  • Must be redeemed by the expiration date

14. Third-Party Services

We may use third-party services such as payment processors, galleries, or scheduling tools.
These companies have their own terms and privacy policies.
